Le 13 décembre 2007, les dirigeants des 27 Etats membres de l’Union européenne se réunissaient à Lisbonne afin de signer le traité modifiant le traité sur l’Union européenne et le traité instituant la Communauté européenne. Ce nouveau texte, aux appellations multiples – mini-traité, traité simplifié, traité réformateur, traité modificatif – est en cours de ratification. Certes, le rejet irlandais du 12 juin 2008 a semblé compromettre, un temps, l'entrée en vigueur du traité. Toutefois, aucun des autres Etats membres ne semblent prêts à renoncer à ce texte et l’idée de convoquer un second référendum a fait son chemin et devrait intervenir le 2 octobre prochain. Surtout, quel que soit son devenir, toute oeuvre de révision présente un intérêt théorique pour l’analyse et la compréhension du droit de l’Union européenne. Sans prétendre faire ici un commentaire article par article du traité de Lisbonne, l’ensemble des contributions propose une analyse fouillée des principales innovations introduites par ce traité en s’efforçant de répondre à une interrogation : ces innovations emportent-elles des reconfigurations nécessaires (et, pour certaines, reprises du projet constitutionnel) de l’Union européenne ou amorcent-elles un processus de déconstitutionnalisation ? Volontairement, l’interrogation est audacieuse, presque ébouriffante. Elle suscite nombre de questions et, en particulier, l’éternelle : peut-on qualifier le processus antérieur de processus de constitutionnalisation ? Si tel est le cas, le traité de Lisbonne prive-t-il le processus de certains de ses attributs constitutionnels ? Le retour à l’intergouvernemental dans le processus d’élaboration est une première indication d’importance, mais sur le fond, qu’en est-il, en particulier si l’on compare à l’existant ? Sans prétendre résoudre l’ensemble de ces questions, l’ouvrage a le mérite, au-delà d’un commentaire technique des modifications enregistrées, d’alimenter la réflexion fondamentale avec toutes les passions que celle-ci peut générer.
